This office has extensive experience in respect of the involuntary (Court Ordered) admission to drug treatment centres / rehabilitation centres, regarding people who are addicted to substances and their family requires the intervention of a Court Order in order to obtain treatment for the person concerned.
Our law allows for a Magistrate’s Court to intervene when a person is someone who is addicted to substances, and a danger to themselves and / or others.

We also offer the service of bringing an Application to Court, for persons who have been arrested for a criminal offence as a result of their drug / alcohol / substance addiction, to convert the criminal trial into an inquiry in terms of the Prevention of and Treatment for Substance Abuse Act 70 of 2008, with a view to obtaining a Section 35 Order for the involuntary admission of the person concerned into a treatment centre.
The Act provides a useful and results driven mechanism to summons a drug addicted person to Court, and in the event they refuse to comply, have them arrested by SAPS to appear for the inquiry.
We work extensively with various treatment centre’s in KZN, and have a 97% success rate at obtaining Orders of this nature. Critically, none of the people who have been placed under Section 35 Orders have relapsed to date.
It is essential that early intervention is made in order to increase the chances of successful rehabilitation.
Our services include the facilitation of social workers reports, drafting of the application for involuntary admission, applications for summons and / or the arrest of the drug user in order to appear in Court for the inquiry. Additionally, in the event a person is already appearing in Court as an accused, we are able to bring an Application in terms of Section 255 of the Criminal Procedure Act, to convert the trial into an inquiry in terms of Act 70 of 2008.
Substance abuse and addiction in these circumstances includes; cocaine; mandrax; daga; heroin; prescription medication; alcohol; crack cocaine etc.
